Definitions
For the purposes of this agreement, "The Photographer/Videographer" is Quinton Meyer and "the Client" is the individual or organisation commissioning services. "Images and video" means any images or video product furnished by The Photographer, whether photographs, prints, video edits or other type of physical or electronic material.
Deposits and Payment
The Client shall make any deposits necessary to secure shoot date(s) as per contract or written communication between the Photographer/Videographer and the Client. Payment terms are 30 days unless stipulated otherwise.
Cancellation
If the Client shall cancel this agreement less than thirty (30) calendar days before the photo or video shoot date scheduled, a cancellation fee of half the quoted rate of the project or a minimum of $250 CAD + HST will apply. Rescheduling due to weather is permitted.
Photographic Materials and Copyright
All photographic and video materials, such as original negatives, photos, or slides, raw and edited footage shall be the exclusive property of the Photographer/Videographer. The Photographer/Videographer shall own the copyright in all images created and may use the work for samples, contests, exhibition, advertising and self-promotion. Usage outside the bounds of this agreement will require the Client's consent.
The Photographer/Videographer is not required to hand over any raw photos or video footage; raw materials can be requested at a fee. When a client commissions a project, the project is defined as the finished end product — any raw materials shall exclusively remain the property of The Photographer/Videographer.
Client's Usage
The Client is obtaining prints/video for personal use only, and shall not sell said prints or authorise any reproductions thereof by parties other than the Photographer/Videographer. If the Client is obtaining prints/video for reproduction, the Photographer/Videographer authorises the Client to reproduce the print/video only as set forth under Special Usage Requirements. In such event, the Client shall request that a copyright and credit notice for the Photographer be placed adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to do so.
Social Media
This clause applies to all social media, including Facebook and blogs. When published online it is required that citation of the Photographer/Videographer be made. The Client agrees that they will under no circumstances alter any photographs or videos that are placed in public on the internet. The Client agrees to be responsible for anyone who posts our photographs/videos online and agrees that they cannot be cropped (with the exception of forced cropping for Facebook's Timeline), altered in colour, or edited in any way.
Failure to Perform
If the Photographer/Videographer cannot perform this Agreement due to a fire or other casualty, strike, or other cause beyond the control of the parties, or due to the Photographer/Videographer's illness, then the Photographer/Videographer shall return any funds previously paid to the Client but shall have no further liability with respect to the Agreement.
This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer/Videographer. In the event the Photographer/Videographer fails to perform for any other reason, the Photographer/Videographer shall not be liable for any amount in excess of the retail value of the Client's order.
High-Resolution Delivery
Images are deliverable in High-Resolution (or known as High-Res). Video resolution will be determined prior to the shoot commencing.
File Retention
The Photographer/Videographer keeps client files inclusive of video edits for up to 2 years after the photography/videography session, and is not liable for any claims after this period. All client files will be deleted and backups will be purged after this period.
Drone & Aerial Services
Drone operations are conducted in compliance with Transport Canada regulations. The Photographer holds a valid Advanced Operations certificate. Flights are subject to airspace availability, weather conditions, and local bylaws.
The Client is responsible for obtaining any required property-owner permissions for drone operations over private land. If a flight must be cancelled on the day due to unsafe conditions or regulatory restrictions, a partial refund for the drone portion may be issued at the Photographer's discretion.
Liability
The Photographer/Videographer will not accept any responsibility due to any accident or damage to public or private properties during the photo/video shooting or consultation session.
Deliverables & Editing
All deliverable images and videos as per contract will have standard image editing. Video edits will be produced as per the Client's requirements inclusive of revisions.
Breaks
The Photographer/Videographer will be allowed one 20-minute break at their own discretion, and bathroom breaks when necessary. The Photographer/Videographer reserves the right to go off-site for a meal for 45 minutes.
Date & Location Changes
It is understood that it is the Client's responsibility to inform the Photographer/Videographer by email of any date or location changes. The Photographer is not liable for any claims for messages sent by mobile text message or social network websites.
Communications
All communications with the Photographer/Videographer shall be made in English and in writing (mail or email).
Travel
Travel to be charged at $0.60 per kilometre, with the first 25 km included.
Amendments
Amendments to these Terms and Conditions apply without prior notice.
